Congress took that away from most employees to pay for other parts of the 2017 Tax Cuts and Jobs Act!
Many Loan Originators act like independent contractors and should have the ability to deduct expenses for advertisements and other promotional items.
Please ask Congress to help small business Loan Originators by permitting them to be classified as a Statutory Employee or reverse the 2017 Tax Cuts and Jobs Act limitation. When the statutory employee designation was created, MLOs did not exist. Given the changes in federal law over the last 8 years, MLOs are now in a very comparable tax position to insurance agents. Given that insurance agents are considered statutory employees, so should mortgage loan originators.
